Commercial litigation firm McDaniel Wolff PLLC served as local counsel to assist London Luxury of New Rochelle, New York, in obtaining a $101.2 million jury verdict against Walmart Inc. The federal jury found that London Luxury was severely damaged when Walmart failed to uphold a contract to buy 75-80 million boxes of nitrile gloves during the COVID pandemic. Along with lawyers at Holwell Shuster & Goldberg, Scott Richardson of McDaniel Wolff PLLC persuaded jurors that Walmart entered into a binding agreement to buy the gloves, but refused to perform its end of the bargain when it was unable to resell the gloves to another party. Despite moving the case venue to Walmart’s home office location of Northwest Arkansas, the jury nonetheless determined that even the largest companies must honor their agreements with their business partners.
The case is London Luxury LLC v. Walmart Inc., W.D. Ark., No. 5:22-cv-05059.
